Although Pennsylvania has not yet been directly targeted, existing compliance issues raise concerns about the state’s adherence to federal regulations.

In April, the U.S. Department of Education initiated an investigation into California’s compliance with Title IX protections, subsequently deeming the state non-compliant last week. A proposed Resolution Agreement mandates that California enforce compliance, particularly prohibiting males from participating in female sports and using female intimate facilities. Furthermore, schools must adopt biology-based definitions of “male” and “female” in their policies.

Earlier this year, a federal judge overturned the Biden administration’s revisions to Title IX that sought to include protections based on “gender identity.” Following this, President Trump issued an Executive Order intended to uphold biological definitions in the face of what he described as “gender ideology extremism.” This move has paved the way for a more stringent federal approach to Title IX, particularly concerning transgender athlete participation in women’s sports.

In Pennsylvania, the Pennsylvania Human Relations Commission (PHRC) provides protections based on “gender identity,” which conflicts with federal standards and recent court rulings. Many school districts across the state continue to allow students to use bathrooms aligned with their gender identity, citing the PHRC’s regulations—despite potential conflicts with federal requirements.

A review of school districts in Bucks, Chester, Delaware, Montgomery, and Philadelphia counties revealed a significant number of non-compliant policies. Over 40% of these districts have specific policies addressing transgender students. Of these, 13 out of the 62 districts (21%) explicitly recognize “gender identity” in their Title IX nondiscrimination policies, while 23 districts (37%) do not incorporate it at all. This indicates that nearly half of the districts in these regions may be out of alignment with federal laws regarding Title IX.

Furthermore, some districts are experiencing scrutiny for their policy language, which some argue promotes gender neutrality or excludes parental involvement in matters of gender identity. A compliant stance on Title IX becomes even more critical given that complaints have already been lodged. For example, a resident of Great Valley School District filed a complaint with the Department of Education regarding the district’s transgender policy, highlighting the growing concern among parents and residents about the dissonance between local practices and federal expectations.

Despite warnings from federal authorities, the Pennsylvania Human Relations Commission continues to uphold its protections for gender identity. Observers note that several district policies may superficially comply with Title IX requirements, yet they often engage in practices that undermine its original intent. As non-compliance persists, it is anticipated that the Trump administration will escalate its investigations into Pennsylvania’s adherence to Title IX regulations.

The recent Case of the University of Pennsylvania has drawn considerable attention as it entered into a Resolution Agreement to rectify its Title IX compliance issues. Following a ruling from the Department’s Office for Civil Rights that found it violated federal sex discrimination laws, Penn is now required to issue apologies to affected athletes and restore accolades that were misattributed to transgender athletes. This agreement also mandates the use of biology-based definitions for “male” and “female,” reflecting the federal directives stemming from Trump’s Executive Orders.

The ongoing investigation into Penn is particularly notable due to its implications for student-athletes. The situation surrounding Lia Thomas, a transgender swimmer who competed on the women’s team, has driven much of the scrutiny of Penn’s policies. As a consequence of the federal demands, records previously held by Thomas were rescinded, adding to the debate over transgender inclusion in sports.

In a dramatic policy shift, the Department of Education has frozen over $175 million in federal funding to the University of Pennsylvania, citing violations of its directives related to fair athletic opportunities for women. As investigations become more focused on individual cases, this represents a significant departure from traditional Title IX enforcement, signaling the Trump administration’s commitment to a stricter interpretation of compliance issues.
